1. Overview

This website is operated by Sarah Jade Duck trading as Little Duck Studios (ABN 97 581 960 351).

Throughout these Terms of Service, “Little Duck Studios”, “we”, “us” and “our” refer to Sarah Jade Duck trading as Little Duck Studios. “You” and “your” refer to anyone who accesses our website, creates an account or purchases a product or service from us.

These Terms of Service apply when you access or use our website, purchase from Little Duck Studios or otherwise use the products, information, features and services made available through our website.

Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to sell our products and services.

By accessing our website or placing an order, you agree to these Terms of Service, our:

If you do not agree to these Terms, you should not use our website or place an order.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

2. Eligibility and accounts

You may browse our website without creating an account.

If you are under 18 years of age, you should only place an order with the involvement and permission of a parent or legal guardian.

When creating an account or placing an order, you agree to provide information that is accurate, current and complete.

You are responsible for:

  • keeping your account credentials secure;
  • activity conducted through your account;
  • promptly updating your account information; and
  • notifying us if you believe your account has been accessed without permission.

You must not sell, transfer or allow another person to misuse your account.

We may suspend or restrict an account where we reasonably believe this is necessary to address fraud, unlawful activity, a security risk, misuse of our website or a material breach of these Terms.

3. Product information

We take reasonable care to ensure our product descriptions, measurements, prices, availability and photographs are accurate.

Colours and product appearance may vary slightly depending on lighting, photography and the settings of the device or screen used to view our website.

Many Little Duck Studios products are handmade, hand-painted or produced in small batches. Natural variations may include slight differences in:

  • shape;
  • dimensions;
  • brushwork;
  • colour;
  • glaze;
  • texture; and
  • surface finish.

These variations form part of the individual character of handmade products and are not considered faults when they are consistent with the product description, photographs and any variations disclosed before purchase.

This does not exclude your rights if a product is faulty, unsafe, materially different from its description or otherwise fails to meet a consumer guarantee under the Australian Consumer Law.

We may update product descriptions, availability and other website information from time to time. Changes will not retrospectively alter an order we have already accepted unless you agree or the change is required by law.

4. Product availability

Some Little Duck Studios products are original, one of a kind or available only in limited quantities. Placing an item in your cart does not reserve it.

We may:

  • limit the quantity of a product available for purchase;
  • discontinue a product;
  • restrict delivery to particular locations; or
  • refuse quantities that reasonably appear to be intended for unauthorised commercial resale.

If an ordered product becomes unavailable after payment, we will contact you and provide a refund for the unavailable item or offer another option for you to accept.

5. Orders

When you submit an order, you are offering to purchase the selected products on these Terms.

An automated order confirmation acknowledges that we have received your order. It does not necessarily mean that we have accepted it.

An order is accepted when we:

  • send you confirmation that it has been accepted or dispatched;
  • begin creating a made-to-order, personalised or commissioned product; or
  • otherwise confirm acceptance in writing.

Please check your order details, delivery address and product selections carefully before submitting your order.

We may decline or cancel an order where reasonably necessary, including because of:

  • a product being unavailable;
  • an obvious pricing or product-information error;
  • unsuccessful or unauthorised payment;
  • suspected fraud or unlawful activity;
  • an incorrect or incomplete delivery address;
  • delivery restrictions;
  • suspected unauthorised commercial resale; or
  • circumstances outside our reasonable control that prevent us from fulfilling the order.

If we cancel an order after receiving payment, we will refund the amount paid for the affected item or order to the original payment method.

6. Order changes and cancellations

If you need to change or cancel an order, contact us as soon as possible. We cannot guarantee that a request can be accommodated after an order has been accepted, packed, dispatched or entered production.

Made-to-order, commissioned, personalised and custom products cannot usually be changed or cancelled once work has commenced.

This does not affect your rights under the Australian Consumer Law, including where a product is faulty or does not match the agreed description.

Little Duck Studios does not provide returns, refunds or exchanges simply because a customer changes their mind. Further information is available in our Refund and Returns Policy.

7. Prices and payment

Unless stated otherwise:

  • prices are displayed in Australian dollars;
  • prices include GST where applicable; and
  • shipping charges are calculated separately and displayed before you complete checkout.

For international orders, you may be responsible for customs duties, import taxes or other charges imposed by the destination country. These charges are not controlled by Little Duck Studios and are not included in the product or shipping price unless expressly stated.

You agree to provide accurate and complete billing and payment information and confirm that you are authorised to use the selected payment method.

Payment must be authorised before an order can be accepted. Payment services may be provided by Shopify or other third-party payment providers and may be subject to their own terms and privacy policies.

We may change product prices at any time, but a price change will not affect an order that we have already accepted, except where you agree to a correction of an obvious error.

8. Pricing and website errors

We may correct genuine typographical, technical or administrative errors relating to product descriptions, prices, promotions, shipping charges, availability or other website information.

If an error affects an order you have submitted, we will contact you as soon as reasonably possible.

Where appropriate, we may give you the option to:

  • proceed with the corrected order;
  • select an alternative product; or
  • cancel the affected item or order for a refund.

We will not charge an increased price for an accepted order without your agreement.

9. Shipping and delivery

Shipping costs and available delivery methods are displayed during checkout or explained in our Shipping Policy.

Any processing or delivery timeframe provided is an estimate unless we expressly agree to a guaranteed timeframe. Delays may occasionally occur because of postal networks, severe weather, natural disasters, customs processing, high-volume periods or other circumstances outside our reasonable control.

We will take reasonable steps to dispatch orders within the stated processing timeframe and assist with investigating parcels that are materially delayed, lost or damaged during delivery.

You are responsible for providing a complete and accurate delivery address. Additional costs resulting from an incorrect or incomplete address may be charged to you where the error was not caused by Little Duck Studios.

Where tracking shows that an order was delivered to the address supplied, responsibility for the parcel generally passes to you upon delivery. This does not apply where:

  • the parcel was not delivered as recorded;
  • the product was damaged before delivery;
  • we sent the parcel to the wrong address; or
  • you otherwise have rights under the Australian Consumer Law.

If your order has not arrived within the expected timeframe, please contact us so we can investigate with the delivery provider.

10. Title to products

Ownership of a physical product passes to you once we have received full payment and the product has been delivered to the address provided with the order.

Copyright and other intellectual-property rights in artwork, designs, images and products do not transfer when you purchase a physical or digital product unless we expressly agree otherwise in writing.

11. Refunds, returns and consumer guarantees

Our products come with guarantees that cannot be excluded under the Australian Consumer Law.

If a product has a major problem, you may be entitled to choose a refund or replacement. If a product has a minor problem, we may choose to repair the product or otherwise resolve the problem within a reasonable time.

You may also be entitled to compensation for reasonably foreseeable loss or damage resulting from a failure to meet a consumer guarantee.

Consumer guarantees may not apply where:

  • you simply change your mind;
  • you misuse a product and that misuse causes the problem;
  • you damage the product;
  • you fail to follow supplied care or safety instructions and this causes the problem; or
  • you were informed of a particular fault before purchasing the product.

Our products do not need to be returned in their original packaging to claim a remedy for a fault under the Australian Consumer Law. We may, however, ask for proof of purchase and information or photographs that reasonably help us assess the problem.

Our Refund and Returns Policy explains how to report a faulty, damaged or incorrect product.

12. Product care and safety

You agree to read and follow any care, handling, display or safety instructions supplied with a product or displayed on its product page.

Ceramics, artworks, homewares and decorative products should be handled with appropriate care. Unless a product is expressly described as suitable for a particular use, you should not assume that it is:

  • food safe;
  • dishwasher safe;
  • microwave safe;
  • oven safe;
  • weatherproof;
  • suitable for use with an open flame; or
  • suitable for children.

Nothing in this section excludes our responsibility for supplying products that comply with applicable consumer guarantees and product-safety requirements.

13. Gift cards and digital products

Gift cards and digital products are subject to any additional conditions displayed on the relevant product page.

Gift-card expiry dates and conditions will comply with applicable Australian law.

You must not reproduce, share, resell, distribute or commercially exploit a digital product unless the applicable product licence expressly permits it.

The unavailability of change-of-mind returns for gift cards and digital products does not exclude any rights you may have if the product is faulty, materially different from its description or otherwise fails to meet a consumer guarantee.

14. Promotions and discount codes

Promotions, competitions, discount codes and special offers may be subject to additional conditions displayed at the time of the offer.

Unless stated otherwise:

  • discount codes cannot be exchanged for cash;
  • only one discount code may be used per order;
  • discount codes cannot be applied retrospectively;
  • promotions are subject to stated availability and dates; and
  • discounts do not apply to shipping or gift cards.

We may withdraw or correct a promotion where there is a genuine error, fraud, misuse or another reasonable basis. This does not affect an order already accepted except where the customer agrees or the law permits it.

15. Intellectual property

Unless otherwise stated, the content available through our website—including artworks, illustrations, patterns, photographs, graphics, logos, product names, designs, written content, video and website layout—is owned by or licensed to Little Duck Studios and is protected by Australian and applicable international intellectual-property laws.

You may access and use our website for your personal, non-commercial use.

Without our prior written permission, you must not:

  • reproduce, copy or distribute our website content;
  • modify or create derivative works from our content;
  • use our artwork, designs or photographs on products;
  • use our content for commercial purposes;
  • remove copyright or ownership notices;
  • use our content to train, develop or improve an artificial-intelligence system or dataset; or
  • represent that you or another person created or owns our content.

Purchasing an original artwork, print, ceramic piece, digital file or other product does not transfer copyright or grant reproduction or commercial-use rights unless we expressly agree otherwise in writing.

16. Reviews, photographs and other customer content

If you voluntarily submit a review, photograph, comment or other content to Little Duck Studios, you confirm that:

  • you created or have permission to submit it;
  • it does not infringe another person’s rights;
  • it is not unlawful, misleading, defamatory or abusive; and
  • you have disclosed any incentive or compensation connected with the submission.

You grant Little Duck Studios a non-exclusive, worldwide, royalty-free licence to reproduce, display and share that content for the purposes of operating, improving and promoting Little Duck Studios.

Where practicable, we will seek further permission before using an identifiable customer photograph in paid advertising.

You retain ownership of your content and may contact us to request that we stop using it. We will take reasonable steps to action the request, although content may remain in materials already printed, published or scheduled before the request was received.

We may moderate or remove content that we reasonably consider unlawful, misleading, offensive, abusive, irrelevant or in breach of these Terms.

17. Acceptable website use

You must not use our website:

  • for an unlawful, fraudulent or malicious purpose;
  • to infringe our rights or another person’s rights;
  • to harass, threaten, abuse or impersonate another person;
  • to submit false or misleading information;
  • to introduce viruses, malware or harmful code;
  • to interfere with the security or operation of our website;
  • to access another person’s account without permission;
  • to collect personal information without authorisation;
  • to send spam or other unauthorised communications;
  • to circumvent access restrictions or technical protections; or
  • to scrape, extract or systematically copy website content without our written permission.

We may take reasonable technical or legal steps to prevent these activities.

18. Third-party services and links

Our website may contain links to or integrations with third-party websites and services, including Shopify, payment providers, social-media platforms and delivery providers.

Third-party websites and services are operated independently and may have their own terms and privacy policies. We do not control their content, availability or practices.

To the extent permitted by law, Little Duck Studios is not responsible for loss caused solely by an independent third-party website or service that we do not own or control.

Nothing in this section excludes responsibility that Little Duck Studios has under the Australian Consumer Law or another law that cannot be excluded.

19. Privacy

We handle personal information in accordance with our Privacy Policy and applicable Australian privacy laws.

Because our store is hosted by Shopify, Shopify and its service providers may collect, process and store information necessary to provide the website, checkout, payment, security and related services.

Our Privacy Policy explains:

  • what personal information we collect;
  • why we collect it;
  • how it is used and disclosed;
  • the third parties that may receive it;
  • whether information may be handled overseas;
  • how you can request access or correction; and
  • how you can contact us with a privacy question or complaint.

20. Website availability and general information

We take reasonable care in operating our website, but we do not guarantee that access will always be uninterrupted, secure or error free.

We may temporarily suspend access for maintenance, security, technical problems or circumstances outside our reasonable control.

General information on our website is provided for informational purposes and should not be treated as professional advice.

To the extent permitted by law, we are not responsible for loss caused solely by reliance on general information where the information was not intended or represented to be professional advice.

21. Limitation of liability

Nothing in these Terms excludes, restricts or modifies:

  • consumer guarantees, rights or remedies under the Australian Consumer Law;
  • liability that cannot lawfully be excluded or limited; or
  • your right to recover reasonably foreseeable loss or damage where provided by law.

To the extent permitted by law, Little Duck Studios is not liable for indirect or consequential loss that was not reasonably foreseeable and was not caused by our breach, negligence or unlawful conduct.

Where the law permits us to limit our liability for a service that is not ordinarily acquired for personal, domestic or household use or consumption, our liability may, at our option, be limited to:

  • supplying the service again; or
  • paying the reasonable cost of having the service supplied again.

This section does not limit liability for personal injury, fraud, wilful misconduct or any liability that cannot legally be limited.

22. Your responsibility for misuse

You are responsible for loss suffered by Little Duck Studios to the extent that the loss is directly caused by your:

  • deliberate or unlawful misuse of our website;
  • material breach of these Terms;
  • infringement of another person’s intellectual-property or privacy rights; or
  • fraudulent or intentionally misleading conduct.

You are not responsible under this section for loss caused or contributed to by Little Duck Studios or for loss that could reasonably have been avoided.

23. Suspension and termination

We may suspend or terminate access to an account or restricted website feature where we reasonably believe that you have:

  • materially breached these Terms;
  • used the website unlawfully or fraudulently;
  • created a security risk;
  • harassed or threatened another person; or
  • interfered with the website’s operation.

Where appropriate, we will provide reasonable notice or an opportunity to address the issue. Immediate action may be taken where reasonably necessary to protect Little Duck Studios, our customers or another person.

Suspension or termination does not affect:

  • rights and obligations arising before termination;
  • an accepted and paid order, unless it is separately cancelled and refunded in accordance with these Terms; or
  • rights available under the Australian Consumer Law.

Provisions that are intended by their nature to continue—including intellectual-property, privacy, liability and governing-law provisions—survive termination.

24. Changes to these Terms

We may update these Terms from time to time to reflect changes to our business, website or legal obligations.

The current version will be published on this page with its effective date.

Material changes will be communicated where required by law. Changes will generally apply prospectively and will not retrospectively alter an order already accepted unless:

  • you agree to the change; or
  • the change is required or permitted by law.

25. Severability

If any part of these Terms is found to be unlawful, invalid or unenforceable, that part will be read down to the extent necessary or severed if it cannot be read down.

The remaining provisions will continue to operate.

26. No waiver

If we do not immediately enforce a right under these Terms, that does not mean we waive that right.

A waiver is only effective if it is given in writing and applies only to the particular circumstances for which it is given.

27. Transfer of these Terms

You may not transfer your rights or obligations under these Terms without our written consent.

We may transfer our rights and obligations as part of a genuine sale, restructure or transfer of Little Duck Studios, provided that the transfer does not reduce your rights. We will provide notice where required by law.

28. Entire agreement

These Terms and the policies incorporated by reference form the agreement between you and Little Duck Studios concerning your use of our website and purchases from us.

Nothing in this section excludes representations, guarantees or rights that cannot be excluded under Australian law.

29. Governing law

These Terms are governed by the laws of Queensland, Australia.

You and Little Duck Studios submit to the non-exclusive jurisdiction of the courts of Queensland and any courts entitled to hear appeals from them.

Nothing in this section limits rights available under the Australian Consumer Law or prevents you from bringing a claim in another jurisdiction where permitted by law.
